2. Incorporation of the Google Play Terms of Service.
This Agreement incorporates by reference the Google Play Terms of Service. For purposes of this Agreement, the "Software" is considered the "Content" and/or "Android App" and/or "App" as defined and/or used in the Google Play Terms of Service, and "Planescape Studio" is considered the "Provider" as defined in the Google Play Terms of Service. If any terms of this Agreement conflict with the terms of the Google Play Terms of Service, the terms of this Agreement shall control.
3. Terms of License
Subject to the terms of this EULA, Planescape Studio grants you a limited, non-transferable, non-exclusive, non-assignable, non-sub-licensable and revocable license to use the Software for your own non-commercial purposes. You agree not to use the Software for any other purpose.

PLANSCAPE STUDIO EXPRESSLY DISCLAIMS TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES RELATED TO NON-INFRINGEMENT, LACK OF VIRUSES, ACCURACY OR COMPLETENESS OF RESPONSE OR RESULTS, OR IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL PLANESCAPE STUDIO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS OR FOR ANY LOSS OR COSTS WHATSOEVER EXPERIENCED BY YOU OR ANY THIRD PARTY (INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, PERSONAL INJURY, LOSS OF PRIVACY OR OTHER PECUNIARY OR OTHER LOSS WHATSOEVER) ARISING OUT OF USE, MISUSE OR INABILITY TO USE THE SOFTWARE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.
IN NO EVENT WILL THE LIABILITY OF PLANESCAPE STUDIO FOR DAMAGES WITH RESPECT TO THE SOFTWARE EXCEED THE AMOUNTS ACTUALLY PAID BY YOU FOR THE SOFTWARE.
7. Termination
Planescape studio reserve the right to upgrade the Software and discontinue support for earlier versions of the Software. You agree to be bound by this EULA unless another one is provided with the addition of new features or with a new version of the Software. Planescape Studio reserves the right to terminate or suspend this EULA at its sole discretion.
8. Indemnity
You shall be liable for all costs and losses incurred by Planescape Studio as a result of your breach of this EULA, or any applicable law or regulation, any violation of third-party rights, any use or misuse of the Software, or any communications spread by means of the Software.
9. Open Source Software
The software licensed under this agreement may include open source software that is subject to open source license terms. Notwithstanding anything to the contrary herein, use of such open source software shall be subject to the applicable open source license terms to the extent required by the applicable licensor. Planescape Studio provides no support for such open source software.
10. Force Majeure
Planescape Studio shall not be liable for any delay or failure to perform resulting from causes outside the reasonable control of Planescape Studio, including without limitation any failure to perform hereunder due to unforeseen circumstances or cause beyond Planescape Studio's control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.
